SN: In 1998, the Federal Court of Appeal determined that the Citizenship Act contained a distinction between natural-born children and adopted children in regard to the obtaining of citizenship. This distinction was found to be discriminatory because it requires permanent residence of a child legally adopted by a Canadian citizen, while a child born to a Canadian outside Canada is a citizen from birth. As a result, an interim measure has been developed allowing persons legally adopted by Canadians and residing outside Canada to apply for a special grant of citizenship under subsection 5(4).
