Identifying unfounded claims
A manifestly unfounded claim is defined as one where the decision maker is of the opinion that the claim is clearly fraudulent.
If the Refugee Protection Division at the Immigration and Refugee Board of Canada (IRB) decides that a refugee claim is manifestly unfounded, the claimant will not have access to the Refugee Appeal Division.
All failed refugee claimants will still be able to ask the Federal Court to review a negative decision. However, there will be no automatic stay of removal for people with manifestly unfounded claims while a judicial review is pending.
