Manifestly unfounded claims
A manifestly unfounded claim is defined in Bill C-11 as one where the decision maker is of the opinion that the claim is clearly fraudulent.
The definition is in keeping with the view of the United Nations High Commissioner for Refugees (UNHCR) Executive Committee, which describes as manifestly unfounded, “those [claims] which are clearly fraudulent or not related to the criteria for the granting of refugee status laid down in the 1951 United Nations Convention relating to the Status of Refugees nor to any other criteria justifying the granting of asylum.” [Source: UNHCR Executive Committee Conclusion 30]
