Judicial review of a citizenship decision: Report to recommend judicial review

This section contains policy, procedures and guidance used by IRCC staff. It is posted on the department’s website as a courtesy to stakeholders.

The following are essential components to include in the report recommending judicial review:

  • a complete rationale for the recommendation to seek judicial review; and
  • a complete description of the errors that warrant judicial review and why the decision is unreasonable.

The report must also contain as much of the following details:

  • names and telephone numbers of the officer and the manager;
  • all relevant file numbers;
  • personal information concerning the person(s) directly involved in the issue to be litigated (that is, the person concerned, sponsors or relatives, and known associates, if relevant). Personal information for each person would include, where known, full names, places and dates of birth, addresses, and numbers and dates of issue of any identity documents issued to or in the possession of the significant parties;
  • name and business address of counsel representing the person concerned;
  • a copy of any order or decision (if available) that is to be reviewed by the Court and the date the order or decision was made or given;
  • a copy of the officer’s notes taken at the hearing;
  • a detailed summary of the decision and the reasons that led to the decision.
